Title IX and Sports

Many people wonder what is Title IX and if they qualify for protection under the law.

Title IX is part of a large education amendment from 1972. It is a federal law that states: “No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.”

Ultimately it means that no sex should be denied the rights and benefits of any education program or activity that receives assistance from the Federal government.

Often this has referred to protections for sexual assault on campus, but it also extends and is widely used for athletics. Title IX and sports have a strong connection that protects all sexes from discrimination.

Since athletic programs are considered activities tied to federal assistance, Title IX applies. It requires that women and men are provided equal opportunity to participate in sports, receives equal scholarships regardless of sex, and many other athletic-related rights and benefits.

What Would be a Violation of Title IX?

Participation

Participation applies to the kinds and amounts of opportunities offered to students of both sexes. For instance, schools must show that they offer a proportionate amount of athletic opportunities for both females and males. If you feel that you’re sex is not being afforded the same amount of opportunities, you’re a good candidate for a Title IX case.

Another way that schools can show they are complying with Title IX rules is by continuing to pursue a wider range of athletic offerings for the sex that is under-represented. If you feel that there is little interest from the institution in expanding the options for the underrepresented sex then you’re a candidate for a Title IX sports lawyer.

Scholarships

Under Title IX, academic institutions are required by law to provide proportional scholarships for both sexes. This does not mean equal in dollar amount, but proportional to the ratio of athletes by sex.

The Myra Sadker Foundation offers this example:

“For example, consider a college with 90 female athletes and 115 male athletes and a scholarship budget of $100,000. An equitable distribution of funds would award $44,000 in scholarship aid to female athletes and $56,000 to males.”

This can be a more subtle type of discrimination that can easily go unnoticed, but if you feel that scholarship money is not being awarded in a proportional amount to each sex then you are a good candidate to seek out a Title IX sports lawyer.
