Max Gruver Hazing Lawsuit: U.S. Supreme Court Rejects LSU’s Request for Review of Lawsuit: Gruver Family/TFNLG Attorney Jonathon Fazzola Says LSU Finally has to Defend the Case on the Merit
The U.S. Supreme Court has rejected a request from LSU to hear arguments in a lawsuit filed by the family of Max Gruver, who died in 2017 after a night of hazing and forced alcohol consumption at his fraternity house. LSU attorneys had asked the Supreme Court to review a May decision from the 5th U.S. Circuit Court of Appeals in New Orleans, which ruled that LSU was wrong in claiming that the university was immune from the Gruvers’ lawsuit under the 11th Amendment, which prevents federal courts from hearing some lawsuits filed against states. But in an order released Monday, the Supreme Court denied LSU’s petition for certiorari, which is a win for the Gruvers.
